The Three Inviolable Statutory Standards (CRA 2015 Part 1)
When you purchase any tool or equipment from Biovertexa UK as a consumer, your purchase is protected by statutory standards that cannot be contracted out under Section 31 of the Consumer Rights Act 2015:
- Satisfactory Quality (Section 9): Tools must meet the standard that a reasonable person would regard as satisfactory, taking into account their description, price, finish, freedom from minor defects, safety, and durability.
- Fit for a Particular Purpose (Section 10): The tool must be fit for the everyday purpose for which tools of that type are normally used, as well as any specific purpose made known to us prior to purchase.
- As Described (Section 11): The equipment supplied must strictly match the technical specifications, voltage platforms, included batteries, accessories, and images published on our product pages.
The 3-Tier Statutory Remedy Timeline
The remedies available to you if a product develops a manufacturing defect depend on when the issue arises:
Short-Term Right to Reject
If the tool is faulty on arrival or fails within 30 days of delivery, you have the legal right to reject it for a 100% full refund or free replacement.
Right to Repair or Replace
The law presumes the defect existed on delivery. We will repair or replace the tool without causing significant inconvenience to you.
Right to Durability Claim
If a professional tool fails prematurely based on expected working life, you can claim a repair, replacement, or partial refund under the Limitation Act 1980.
Exercising Your 30-Day Short-Term Right to Reject (Section 20 & 22)
If you receive an item that fails to conform to statutory standards within 30 calendar days of delivery:
- You are entitled to a full refund of 100% of the purchase price, including any delivery fees paid.
- Biovertexa UK will provide a free prepaid return shipping label (DPD or Royal Mail Tracked).
- Refunds are processed within 3 to 5 business days of the product arriving at our Maidenhead facility.
- Alternatively, you may elect to accept a brand-new direct replacement tool with express same-day dispatch.
Remedies Beyond 30 Days: Repair or Replacement (Section 23)
If a defect develops after 30 days but within the first 6 months:
- Reversed Burden of Proof (Section 19(14)): The law presumes the tool was defective at the time of delivery unless Biovertexa can prove it resulted from customer misuse, neglect, or accidental damage.
- First Remedy: We will provide a repair or replacement within a reasonable time and without significant inconvenience, covering all carriage costs.
- Final Right to Reject (Section 24): If a repair or replacement is unsuccessful after one attempt, or cannot be provided within a reasonable timeframe, you have the statutory right to a price reduction or a final right to reject the goods for a refund.
Statutory Durability Claims (Up to 6 Years)
Under the Limitation Act 1980 (applicable in England and Wales; 5 years under the Prescription and Limitation (Scotland) Act 1973), consumers have up to six years to pursue a breach of contract claim where a tool fails to provide reasonable durability.
After the initial 6 months have elapsed, the burden shifts to the consumer to provide reasonable evidence (such as an independent engineer report or service center assessment) confirming that the fault is an inherent manufacturing defect rather than normal wear and tear or jobsite abuse. If an inherent fault is confirmed, Biovertexa will reimburse inspection costs and arrange an appropriate remedy.
Manufacturer Warranties vs. Statutory Rights
Many professional brand tools sold on biovertexa.com include extended manufacturer commercial warranties (e.g. DeWalt 3-Year Extended Warranty, Milwaukee REDLITHIUM Warranty, Makita 3-Year Service Care):
Smart Connected Tools & Digital Content Rights (Chapter 3)
For tools featuring embedded firmware, Bluetooth inventory tracking (e.g. Milwaukee ONE-KEY™, DeWalt Tool Connect™), or mobile companion applications:
- Digital content must be of satisfactory quality, fit for purpose, and as described.
- If digital content damages your smartphone or other hardware due to defective coding, you are legally entitled to repair or compensation under Section 46 of the CRA 2015.
